Bill Aims to Settle ND Disputes Without Court Battles

Derrick has frequently represented clients in court against Continental Resources over damages. Discussion between Braaten and a Continental Resources attorney led to Senate Bill 2335, which introduces mediation to reduce lawsuits.

Supported by Northwest Landowners Association, the bill allows landowners to get an appraisal if they reject a compensation offer. The developer will pay for the appraisal and has 30 days to make a new offer. This aims to encourage private agreements and reduce court cases by providing a third-party number that gives a starting point for negotiations. If no agreement is reached, the case can still end up in court, though the appraisal is not admissible. The bill passed unanimously in the Senate and received a unanimous do pass recommendation from the House committee.
