Landowners Oppose Summit Plans In Contentious Hearing

During a recent 3-day North Dakota Industrial Commission hearing related to the proposed Summit carbon sequestration project and underground storage permits, Derrick was on hand to represent multiple landowners who are concerned about “potential health hazards, lack of economic benefit, unfair treatment of landowners and Summit’s refusal to share crucial modeling data.”

Summit has signed leases with landowners within the proposed storage areas who are voluntarily giving use of their pore space. However, Summit is now attempting  to force nonconsenting property owners to lease their pore space through a legal process called amalgamation. Kurt Swenson was present for the hearing and explained that he will not be forced into a lease with Summit:

“The state can try and take it. You’re going to end up taking it from my cold, dead hands.”
